1. Application of the Conditions of Sale

   1. All orders made to Caffita System by Internet, fax or telephone are covered by the present Conditions of Sale, drawn up in compliance with current regulations on contracts made outside business premises. By forwarding the order, one declares that the present Conditions of Sale have been read, understood and accepted.
   2. Caffita System reserves the right to modify the present Conditions of Sale at any time, publishing the new version on this web site. The applicable Conditions of Sale are those in force at the time the order is placed.

2. Registration: user code and password

   1. To place an order you must be registered. Make certain that the mandatory information you provide is correct and complete.
   2. In case of a change of address or other modifications, please promptly update your personal data.
   3. When you register on this site, you will be asked to input a password. This password is strictly personal and confidential and must not be transmitted to others.
   4. You assume full responsibility for use of your password and for all orders forwarded with that password, even if placed unbeknown to you.
   5. If you become aware, or suspect, that someone else knows or is using your password, please inform Caffita System immediately.
   6. When you register, the system gives you a customer code which, together with the password you have selected, enables the system to recognize you and admit you to your personal Caffitaly area.
   7. By registering in the Caffitaly, you agree to have your personal data handled in compliance with what is outlined in Italian law 675/96 (and subsequent updates). (see information on privacy regulation)
   8. Caffita System gathers and uses your data only to improve and complete the services offered. For example, to promote and provide our products and services, to ship and invoice the products and services requested, to evaluate the efficiency of our activities and to better define our development strategies, or to communicate with you for other unforeseen reasons.

3. Orders

   1. By placing an order through this web site, by fax or by telephone, you commit to purchase the products you have selected, in compliance with the present Conditions of Sale.
   2. Once forwarded to the system, it is not possible to modify or block an order, thus you are responsible for making certain that the order is correct before confirming it.
   3. When you confirm orders made through this web site, you will be sent an e-mail confirmation of the order that was just placed.
   4. Caffita System offers its products on this site within the limits of availability in stock.
   5. Caffita System reserves the right, at its own discretion, to reject orders, in particular if previous invoices have gone unpaid.
   6. The data recorded by Caffita System are deemed proof of order and of the entire transaction. The data recorded by the payment system constitute proof of financial transaction.

4. Price

   1. The prices applied for the products you order are those indicated on this site on the date the order is placed. These prices are understood as inclusive of V.A.T. They do not include shipping costs.
   2. Shipping costs are invoiced according to the rates indicated on this site on the date the order is placed.
   3. Caffita System reserves the right to modify its prices and the shipping costs at any time and to void any order that shows evident error in the calculation system and data.

5. Delivery of the goods

   1. All orders placed are delivered to the shipping address you specified at the time the order was placed.
   2. The delivery date is understood as a preference but is not binding on Caffita System which will nevertheless do everything it can to guarantee prompt compliance.
   3. The deliveries can only be made in Italy.
   4. You are responsible for checking the quantity and condition of the goods at the time of delivery.
   5. If you find the goods have been damaged or do not comply with what was ordered, notify the shipper and sign the delivery document with reservations. The shipper will notify Caffita System within 3 days of delivery. In this case, after checking, Caffita System will replace the missing or damaged goods, in compliance with your order.

6. Right to cancellation

   1. In compliance with art. 5 D. of Italian law 185/1999, regarding remote retailing, the Consumer has the right to cancel the purchase contract for any reason whatsoever and without providing any explanation, at the conditions indicated. To exercise this right, the customer must send a Registered Letter notifying the company of this, within 10 working days of date of receipt of the goods. Communication must be sent to: Caffita System – Centro Direzionale Milanofiori 5/V -20089 Rozzano (MI).
   2. Caffita System will only accept goods returned in good condition and in their original packaging, accompanied by the invoice. The goods must be returned, to the same address, within 30 days of the date on which they were delivered. The Consumer is responsible for the shipping costs for returned goods.
   3. If returns comply with the indications above, Caffita System will reimburse the price of the goods returned and the invoiced shipping costs, within 30 days of receipt of the returned goods.

7. Means of payment

   1. The invoices are sent with the goods.
   2. For goods shipped C.O.D., you will pay the amount directly to the to the person making delivery at the time the goods are received, either with a not negotiable check made out to the shipper or in cash.

8. Product images

   1. The images of the products and means of consumption indicated on the Caffitaly site are considered purely illustrative and are not binding.

9. Force Majeure

   1. Caffita System will make every effort to fulfill its obligations. Nevertheless, Caffita System cannot be held responsible for delays or missed deliveries due to circumstances beyond its reasonable control. These circumstances include strikes, wars, natural catastrophes and any other event that makes production, shipping or delivery of the product impossible.

10. Site for application of the law and Court of competent jurisdiction

    1. The present Conditions of Sale are governed by Italian law. For anything not specifically indicated in the present Conditions of Sale see Italian law 185/99 “implementation of directive 97/7 regarding consumer protection for remote retail contracts”.
    2. The Court of Milan, Italy has jurisdiction for any controversy that may arise regarding the present Conditions or the sale of the products.
